Submitting Subpoenas to Comenity Bank and Comenity Capital Bank




Subpoena Requests

If you seek documents or information from a subsidiary bank of Bread Financial (Comenity Bank or Comenity Capital Bank) in connection with a legal matter, please send your subpoena request using one of the following methods:

Processing time

Our processing time to respond to subpoenas is approximately 30 calendar days after we receive a properly served subpoena. We may be unable to provide responsive documents in a timely manner if less than 30 days’ notice is provided.


In some cases, it may take more time to fulfill the subpoena request, such as if extensive information is requested or insufficient information is provided with the subpoena. During high volume periods, subpoena fulfillment may take up to 60 calendar days.


Subpoena requirements

To avoid additional delay, requestors should ensure subpoenas are properly issued and served.


Subpoenas and related legal orders should clearly identify the documents and records requested. Subpoenas received with vague requests (e.g., “any and all”) may result in limited responses.


To be valid, subpoenas must:

  • Indicate the court/jurisdiction and include the case number and case style or have an agency letterhead.
  • Be issued to the correct entity (Comenity Bank or Comenity Capital Bank) based on any accounts involved.
  • Be signed and dated.
  • Identify the account or accounts for which records are requested.
  • Provide sufficient information to identify the account, such as:
    • Customer’s full name and SSN or EIN
    • Customer’s full name and account number


Additional documentation

Motions to Quash or Objections must be received prior to the date on which Comenity Bank, Comenity Capital Bank, or both banks must legally comply with the subpoena to prevent the release of records. In such instances, the compiled records will be retained and released only upon court order, joint stipulation of the parties or with the customer’s written authorization. We also reserve the right to request supporting documentation to determine how the requested records are relevant to the pending litigation or proceeding.

Payment and fees
